Disclaimer
1. Not Legal Advice
The Waivern Consent Analyser (the "Tool") is provided by Waivern Limited ("Waivern", "we", "us") for informational purposes only. The reports, findings, and recommendations generated by this Tool do not constitute legal advice, regulatory guidance, or professional compliance consulting. You should not act or refrain from acting on the basis of information produced by this Tool without first seeking qualified legal counsel familiar with your specific circumstances and applicable jurisdiction.
2. No Warranty of Accuracy or Completeness
This Tool performs automated technical analysis of website consent mechanisms and cookie behaviour. While we endeavour to maintain accuracy, we make no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of any information produced by this Tool. Automated analysis is inherently limited and may produce false positives (incorrectly flagging compliant behaviour) or false negatives (failing to detect non-compliant behaviour).
3. Limitations of Automated Analysis
The Tool analyses websites from a single geographic location at a specific point in time using automated browser technology. Results may vary based on factors including but not limited to: the geographic location of the analysis server, network conditions, website A/B testing, dynamic content loading, bot detection mechanisms, consent management platform configuration changes, and browser rendering differences. The Tool cannot assess legal compliance holistically — it examines only the technical aspects it is programmed to test.
4. AI-Generated Content
AI-enhanced reports are generated using third-party artificial intelligence services (Anthropic Claude). AI-generated regulatory citations, risk assessments, enforcement precedents, and remediation recommendations may contain inaccuracies, hallucinations, or outdated information. AI outputs should be independently verified by qualified professionals before being relied upon for any compliance or business decision.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Waivern Limited, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, business opportunities, or regulatory fines — arising from or in connection with your use of, or inability to use, this Tool or any information it produces, even if Waivern has been advised of the possibility of such damages.
6. Third-Party Websites
This Tool analyses third-party websites that are not owned or controlled by Waivern. We have no control over, and assume no responsibility for, the content, privacy practices, or compliance posture of any third-party website. Analysis of a website does not imply any relationship between Waivern and the website operator.
7. Data Processing
URLs submitted for analysis, report data, and associated metadata are processed and may be stored on our servers to deliver the service. AI-enhanced reports involve transmitting report data to third-party AI providers. Please review our Privacy Policy for full details on how we handle your data.
8. Changes to This Disclaimer
We reserve the right to modify this disclaimer at any time. Continued use of the Tool following any changes constitutes acceptance of the revised disclaimer.
This disclaimer is governed by and construed in accordance with the laws of the jurisdiction in which Waivern Limited is incorporated.
